“Collection and Preservation of Social Media” Provides Legal Background, a Comprehensive Overview of Vendors, and Specific Recommendations for Managing and Preserving Social Media Content

Austin, TX—October 16, 2012 — Companies can no longer claim ignorance when it comes to managing and preserving social media content for compliance and litigation purposes. That’s the premise of “Collection and Preservation of Social Media,” the latest report in the “eDiscovery and the Cloud” series from eDJ Group, a leading eDiscovery analyst and consulting firm and parent company of eDiscovery Journal. The new report – the first of its kind – is a unique, comprehensive resource for corporations attempting to mitigate the many risks presented by the rapidly growing popularity of web-based tools for online sharing, networking and collaboration in the workplace, including Facebook, Twitter, Google+ and LinkedIn.

While the widespread use of these tools in the workplace presents challenges for legal and information governance professionals, the integration of social media activity into everyday business practice has gained broad acceptance. Although little prescription exists in terms of regulatory rules and case law, the courts are making it increasingly clear that companies are responsible for the collection and preservation of social media content when conducting eDiscovery.

“Social media presents formidable information governance and eDiscovery challenges due to the diversity of data types and metadata, the unprecedented volumes of data, and the complex questions it raises about privacy and the ability to comply with the terms of use established by social media publishers,” said Barry Murphy, co-founder and analyst of eDJ Group. “eDJ Group’s new report is a complete and authoritative guide on the topic, giving companies the essential information they need to address these challenges now and put the right policies, processes and tools in place to prevent social media eDiscovery nightmares down the road.”

Sections of the new report cover emerging rules and case law, side-by-side comparisons of the privacy and consumer protection policies of major social media publishers, and the importance of establishing authenticity in defensible collection and preservation. A variety of methods for collecting and preserving social media are discussed, including web crawling, screen shots, proxy methods, application programming interfaces (APIs) offered by major publishers and publisher-specific methods. The report also presents a detailed look at 26 vendors in today’s eDiscovery marketplace that offer products and services related to social media content.

“Collection and Preservation of Social Media” concludes with specific recommendations to help companies establish sound information governance policies that ensure reasonable efforts are made to collect and preserve social media content as necessary, but also allow employees to use social media when appropriate.

“Social media is the next email – a collaboration platform that grows so quickly that companies really struggle to manage it,” said Murphy. “Instead of falling behind and repeating the mistakes many of us made with email a decade ago, companies need to plan social media governance strategies now.”

The report is now available via eDJ Group’s research engine and eDiscovery technology/service comparator, the eDiscovery Matrix (www.ediscoverymatrix.com). For more information about research licenses and access to this report, please contact Jason Velasco (jason@edjgroupinc.com).

“eDJ Group is excited to offer this powerful information resource to help eDiscovery professionals get fast answers to their toughest questions. eDiscovery professionals have a challenging job with very tight deadlines. It is imperative that they understand both industry best practices as well as how to sort through the confusing array of solutions and services available on the market,” said Jason Velasco, CEO of eDJ Group, Inc. “The eDiscoveryMatrix delivers a comprehensive, easy-to-use resource that allows users to quickly access the knowledge of eDJ’s top-tier analysts to get the information necessary to make the right decisions.”

Formation of the premier market research firm showcases the demand for services eDJ has been providing on information governance and e-discovery since its 2009 founding

BOSTON, Mass. — October 25, 2011 – The founders of eDiscoveryJournal (eDJ), a leading source of independent and unbiased perspectives on eDiscovery news, trends and best practices, today announced the launch of eDJ Group, Inc. The official formation of the legal industry’s newest market research and consulting firm integrates and showcases the demand for the services eDJ has been providing to its legal, IT and service provider clients since opening in 2009.

“eDJ Group’s ability to cover competitive market dynamics, best practices and trends–not only at the strategic level, but also at a very granular level–sets us apart from other firms,” said Barry Murphy, principal analyst and co-founder of the eDJ Group. “Our unique combination of market research, hands-on e-discovery experience and IT acumen has established us as the market research leaders covering information governance and e-discovery requirements.”

eDJ was co-founded in 2009 by Barry Murphy–who, while at Forrester Research, was one of the first analysts in the industry to cover the e-discovery market–and Greg Buckles, one of the industry’s leading e-discovery experts with more than 20 years’ experience working in consulting and leadership roles for legal service providers, corporate legal departments, law firms and IT/software development. Last May, eDJ added Jason Velasco as CEO to drive the rapid expansion of the firm’s research products, content and services.

“The expansion and growth of eDJ Group’s consulting and analyst services are being driven by the strong demand we’re seeing in the market today,” said Buckles. “Organizations–from the smallest law firm to the corporate clients–are coming to us for guidance and support because of our unique expertise.”

According to Velasco, a long-term member of the Electronic Discovery Reference Model (EDRM) and Sedona Conference, the official launch of the company as a market research firm represents the first step in the group’s expansion effort. eDiscoveryJournal will operate under the eDJ Group umbrella, and new products are expected to be rolled out over the next few months, including the relaunch of the eDJ Tech Matrix and the new eDJ TV, an interactive forum, which will provide access to eDJ’s analysts in real time.

Velasco brings 15+ years of legal and eDiscovery expertise to grow eDJ’s products and services, including the journal’s new quarterly industry report

BOSTON — May 23, 2011 – eDiscoveryJournal (eDJ), a leading source of independent and unbiased perspectives on eDiscovery news, trends and best practices, announced today the hiring of Jason Velasco as its new CEO. Velasco, one of the founders of Renew Data Corp., brings more than 15 years of legal and eDiscovery expertise to eDJ and will lead the continued growth and expansion of the journal’s products and services.

“When we started eDJ over a year and a half ago, our goal was to help corporate legal departments, law firms, service providers and vendors understand the eDiscovery technology landscape and how these technologies can maximize productivity and increase profits,” said Barry Murphy, co-founder of eDJ. “Because of our laser focus, eDJ has grown by more than 60 percent. eDJ now has dozens of clients, and our website receives between 6,000 – 8,000 unique visitors per month. Jason’s understanding of the entire legal process will be critical to realizing the potential of the eDJ brand.”

The hiring of Velasco and the expansion of eDJ come at an opportune time. eDiscovery continues to be one of the major challenges for legal departments. Courts are enforcing eDiscovery rules, and compliance requirements with increasing rigor, often resulting in hefty sanctions. Corporations are monitoring litigation budgets more closely and investigating technologies to bring eDiscovery processes in-house, fueling fierce competition among law firms and traditional eDiscovery service providers.

“Jason brings to eDJ the right combination of executive expertise and experience essential to growing our well-established, independent analyst brand,” said Greg Buckles, co-founder of eDJ. “Under his leadership, we will drive the rapid expansion of our research products, content and services to meet the current and future demands of the explosive eDiscovery market and our clients.”

With more than 15 years in the eDiscovery market, Velasco has held high-level positions at several major companies, consulting with both corporations and law firms on best practices, procedures and protocols for managing eDiscovery matters. Most recently, he was a director in the Directed Advisory Services practice at KPMG. He has also held executive positions at Merrill Corporation and RenewData, supervising forensics and consulting teams, as well as closing multimillion dollar deals.

“I’m extremely excited to be leading this dynamic, growing organization. The knowledge and understanding Barry and Greg have on issues related to technology, eDiscovery strategy, litigation readiness and the Electronic Discovery Reference Model (EDRM) are unmatched. They are truly pioneers in this field, and Barry was one of the first IT analysts to understand and cover this market,” said Velasco. “As CEO of eDJ, I’m looking forward to expanding the portfolio of services and products specifically designed for the legal market.”

In the first expansion phase, Velasco will be adding exclusive reports for law firms and corporate IT departments, as well as a new, quarterly “state-of-the-industry” research report that covers the latest rulings, technologies and trends impacting today’s legal departments, along with actionable recommendations to address these challenges. To learn more information about eDJ’s products and services, visit the company’s website here.
